Terms of service

Purpose

These terms of service govern the use of the wellfirst.app website and the WellFirst mobile app, published by WellFirst. By creating an account or using the service, you accept these terms in full.

The service

WellFirst lets a Client complete a daily Check-in — eight short questions about sleep, activity, any pain, hydration, nutrition and mood — then view a synthetic Score and how it changes over time.

A Client can be linked to a coach, who then follows several Clients from a dashboard. That link always results from an invitation accepted by the Client.

Account

Using the app requires creating an account with an email address and a password. You are responsible for keeping your credentials confidential and for any activity carried out from your account.

The display name is free-form: you may use a pseudonym. The email address, however, must be valid and yours, since it identifies you and lets you recover access.

An account is personal and may not be shared.

One Check-in per day

A Check-in is submitted once per calendar day. Once submitted it cannot be edited: the Score and the history would be worthless if past answers could be rewritten. You remain free not to complete a Check-in on any given day.

The coach's role

If you accept a coach's invitation, they gain access to all of your answers, including those predating the link, to your Score and to its evolution. They can neither edit nor delete your data.

A coach acts under their own professional responsibility. WellFirst provides a tracking tool: the advice, programmes or recommendations a coach gives you are neither produced, validated nor reviewed by WellFirst.

Medical disclaimer

WellFirst does not replace a healthcare professional. The Score and indicators shown are self-reported trend data, not diagnoses, and the app is not a medical device. In case of persistent pain, unusual symptoms or any health problem, consult a qualified professional. Never stop or change a treatment based on what you read in the app.

Eligibility

The service is available to anyone aged 16 or over. Minors aged 16 to 18 must have their legal guardian's consent.

Use

You agree to use the service for its intended purpose and not to:
  • Use it for unlawful purposes
  • Attempt to bypass security measures or access another user's data
  • Reproduce, distribute or exploit its content without authorisation
  • Enter information about a third party without their consent
  • Disrupt its operation

Subscriptions and payments

The coach subscription is handled through RevenueCat and billed directly by Apple's App Store or the Google Play Store depending on your device. Renewal, cancellation and refund requests are governed by the terms of the platform you subscribed through, and are managed from its subscription settings. WellFirst neither collects nor stores any payment card data.

Deleting your WellFirst account does not cancel an active subscription: it must be cancelled with the platform.

Termination

You may stop using the service and delete your account at any time from the app (Settings → Danger zone), which erases your data as described in the privacy policy.

We may suspend or terminate an account in case of a clear breach of these terms, with prior notice except in cases of urgency or manifest illegality.

Service availability

We aim to keep the service continuously available, without guaranteeing it. We reserve the right to interrupt the service for maintenance, favouring low-usage windows.

Intellectual property

WellFirst retains all rights to the app, the website, their code, design and content. Your Check-in answers are yours: we use them only to provide the service described here.

Liability

WellFirst is responsible for the proper functioning of the service under French law. We cannot be held liable for decisions you make based on the Score, for advice given by a coach, or for downtime attributable to a third-party provider or to your connection.

Changes to these terms

We reserve the right to modify these terms. Users will be informed of substantial changes by email or by an in-app notification before they take effect.

Governing law

These terms are governed by French law. In the event of a dispute, an amicable solution will be sought first; failing that, the French courts have jurisdiction. Under the French consumer code, you may also refer the matter free of charge to a consumer mediator.
